Acceptance of these terms

By accessing or using this website, you acknowledge that you have read and agree to these Terms and Conditions. If you use the website on behalf of an organisation, you confirm that you are authorised to act for that organisation in relation to the website use concerned. If you do not agree, please discontinue use of the website.

Additional terms may apply to a particular enquiry, portal account, proposal, tender, project, inspection, recruitment process, or professional service.

Identity and scope

This website is operated by Apul Engineering (Consultancy) Paramarsha Sewa (“AECPS”, “we”, “us”, or “our”), Registration No. 80/5273/076/077, Bedkot Municipality Registration No. 113, and PAN 611359931.

These terms apply to the public website, project-enquiry experience, links and communications initiated through it, and the client-portal interface. A third-party website, platform, bank, payment network, email service, or messaging application is governed by its own terms.

Website information is general

Website content describes our company, experience, capabilities, sectors, process, and services in general terms. It is provided for introductory information and is not site-specific engineering advice, a design, drawing, calculation, specification, safety instruction, certification, statutory approval, tender commitment, warranty, or recommendation for a particular project.

Professional reliance

Do not construct, procure, tender, approve, certify, or make a safety-critical decision solely from website content. Engineering decisions require an agreed scope, reliable project information, applicable standards, site conditions, and assessment by appropriately qualified professionals.

We make reasonable efforts to keep published information useful and current, but service availability, personnel, project counts, experience indicators, locations, regulations, standards, and website content may change.

Enquiries and professional engagement

Submitting or preparing an enquiry, sending an email or WhatsApp message, making a telephone call, requesting a meeting, or receiving a general response does not by itself appoint AECPS, create an engineer-client relationship, confirm acceptance of work, reserve personnel, guarantee availability, or require either party to proceed.

An engagement arises only when the applicable scope, responsibilities, deliverables, fee, schedule, assumptions, and other material terms are accepted through an authorised proposal, agreement, work order, contract, or another legally effective arrangement. Acknowledgement of a message is not necessarily acceptance of an engagement.

Electronic messages can be delayed, intercepted, filtered, misdirected, or incomplete. Confirm urgent, confidential, contractual, or safety-critical matters through an agreed official channel. The website must not be used for emergency reporting.

Project-specific agreements control

Professional services are governed by the documents agreed for that project. Those documents may address scope, exclusions, standards, programme, client inputs, variations, intellectual property, confidentiality, payment, suspension, termination, liability, dispute resolution, and other project requirements.

If these website terms conflict with an executed project-specific agreement, the project-specific agreement controls for that project to the extent of the conflict. The Privacy Policy continues to govern relevant website personal-information practices unless a more specific lawful notice applies.

Only a person with appropriate authority may commit AECPS to a proposal, variation, waiver, representation, certification, or contract.

Estimates, schedules and project decisions

Any preliminary estimate, budget range, schedule indication, feasibility comment, quantity, rate, or project opinion given before adequate investigation and written agreement is indicative only. It may depend on assumptions, third-party information, surveys, ground conditions, access, approvals, market prices, taxes, utilities, design development, weather, procurement, contractor performance, and other matters outside our control.

A portal status, dashboard, Gantt chart, progress percentage, meeting record, or informal communication does not constitute completion, acceptance, payment certification, regulatory approval, or a contractual variation unless the applicable project documents expressly provide otherwise.

Your responsibilities

When using the website or communicating with us, you agree to:

  • provide information you are authorised to provide and that is accurate to the best of your knowledge;
  • avoid uploading or sending unlawful, malicious, misleading, infringing, or unnecessarily sensitive material;
  • independently retain original project records and verify important instructions and deliverables;
  • obtain necessary rights and permissions for drawings, photographs, reports, site data, personal information, and other material supplied to us; and
  • comply with applicable law and any project-specific obligations.

You remain responsible for decisions made without an agreed AECPS instruction or deliverable and for the conduct of contractors, suppliers, consultants, authorities, and other third parties appointed independently of AECPS.

Client portal access

Portal access is restricted to authorised users using a Client ID and credentials issued or approved by the AECPS Information Technology (IT) team. Online self-registration, account creation, password reset, and profile manipulation are not supported unless AECPS expressly introduces those functions.

  • Keep credentials confidential and do not share or transfer access.
  • Use the portal only for the client, project, and purpose for which access was granted.
  • Notify AECPS promptly of suspected loss, compromise, or unauthorised activity.
  • Do not attempt to access another account, hidden data, source code, system, or restricted function.

We may verify access, restrict or suspend an account, require credential changes, or preserve relevant records where reasonably necessary for security, maintenance, legal compliance, or protection of a client or project. Portal functions and availability may differ by client and project.

Acceptable website use

You must not misuse the website. Prohibited activity includes:

  • attempting unauthorised access, security testing, credential attacks, or circumvention of access controls;
  • introducing malware, harmful code, automated scraping, excessive requests, or disruption;
  • altering, impersonating, misrepresenting, or fraudulently using AECPS communications or identity;
  • using website content to create a false endorsement, partnership, certification, affiliation, or professional representation; or
  • using the website in a way that violates law or the rights, confidentiality, privacy, or security of another person.

Interface measures that discourage copying or source inspection are not security guarantees and do not authorise access or use that would otherwise be restricted by these terms or law.

Intellectual property

Unless otherwise stated, the website’s original text, layout, graphics, photographs, illustrations, logo presentation, and other original material are owned by or licensed to AECPS and are protected under applicable intellectual-property law.

You may view and print reasonable extracts for personal evaluation of our services. You may not reproduce, publish, modify, sell, license, commercially exploit, remove attribution from, or create misleading derivatives of website material without prior permission or another lawful basis.

Project drawings, calculations, models, specifications, reports, BOQs, and other deliverables are governed by the applicable project agreement and are not licensed merely because similar services are described on this website. Third-party names, marks, and logos remain the property of their respective owners.

Third parties, banking and payments

External links and services—including Google Maps, Google Fonts, WhatsApp, email, telephone services, Jira references, reCAPTCHA references, and other platforms—are provided for convenience or identification. We do not control their content, availability, security, or terms and do not endorse all content available through them.

The “Official Banking and Payment Channels” display identifies a banking channel used by AECPS and payment networks we accept. It does not represent a partnership, agency, sponsorship, endorsement, joint venture, or memorandum of understanding with the displayed institutions or networks.

Verify before paying

This website does not currently collect or process payments. Confirm account details, payment reference, amount, and recipient through an official AECPS contact before transferring funds. Do not rely on unexpected instructions or unverified messages.

Careers and recruitment

A careers-page notice, expression of interest, application, interview, or communication does not guarantee employment, engagement, placement, selection, or a response. A vacancy exists only when formally published or otherwise confirmed by an authorised AECPS representative.

Applicants are responsible for providing accurate information and meeting applicable education, licensing, accreditation, immigration, professional, and legal requirements. No employment or engagement exists until the required terms and documentation are formally completed.

Availability, disclaimers and liability

The website is provided on an “as available” basis. We may change, correct, maintain, restrict, suspend, or discontinue any public or portal feature. We do not guarantee uninterrupted availability, compatibility with every device, freedom from every error or harmful component, or that every message will be received.

To the maximum extent permitted by applicable law, AECPS is not liable for indirect, incidental, special, or consequential loss arising solely from use of, inability to use, or reliance on the public website or an external service. Any liability arising from professional services is governed primarily by the applicable project agreement and mandatory law.

Nothing in these terms excludes or limits liability, remedies, or consumer rights that cannot lawfully be excluded or limited, including liability that applicable law does not permit us to disclaim. Nothing here excuses fraud, wilful misconduct, or another responsibility that cannot legally be waived.

Privacy and communications

Our Privacy Policy explains how personal information may be handled through this website and related communications. By choosing email, WhatsApp, telephone, maps, or another external service, you also interact with that provider under its own privacy practices and terms.

Changes and termination

We may update these terms when the website, services, technology, or legal requirements change. The revised terms will be published here with an updated effective date. Continued use after publication means the updated website terms apply from that effective date, subject to applicable law.

We may restrict website or portal access where reasonably necessary to protect security, users, clients, projects, rights, systems, or legal compliance. Provisions intended by their nature to continue—including intellectual property, disclaimers, liability, governing law, and project-document priority—survive termination of website access.

Governing law and disputes

These website terms are governed by the laws of Nepal. Before starting formal proceedings, the parties should, where appropriate, attempt in good faith to resolve a website-related concern by written communication. Unresolved disputes are subject to the jurisdiction of the courts or other competent authorities of Nepal as determined by applicable law.

If a provision is held invalid or unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue where legally possible. A delay in enforcing a provision is not a waiver of that provision.
